Abstract |
The article explores the participation of counsel in civil proceedings relating to the violation of antitrust law, examined civil procedure and arbitration procedure rules of the law, as well as regulations on the protection of competition, and revealed the problems of counsel’s participation in civil proceedings in cases involving the violation of antitrust law. The amendments made to the civil procedure legislation of the Russian Federation are analysed and considered. The authors conclude that counsel, as a representative of the plaintiff in court proceedings in cases involving a violation of antitrust law, is intended to provide economic entities and citizens with qualified legal assistance in the use of the right to a shield from monopolization and unfair competition established by article 34, paragraph 2, of the Constitution of the Russian Federation. |
